FunGen licence

FunGen is proprietary software. It is free of charge for personal, noncommercial use under the PolyForm Strict License 1.0.0 together with the FunGen Supplemental Terms. Both apply. The full text of each is below.

This summary is not the licence and does not replace it. It is here so you do not have to read the legal text to know where you stand.

Commercial licence

Selling scripts made with the Pro AI features, using FunGen on behalf of an organisation, or running it in a paid production pipeline, needs a written commercial licence. Section 4 of the Supplemental Terms below is the frame every one of them is built on:

Privacy

The app's current network behaviour is described on the privacy page. Your videos, scripts and edits are processed locally. The app's network requests are listed there.

The base licence, used verbatim and unmodified. It is a standard, off-the-shelf licence: polyformproject.org/licenses/strict/1.0.0. It permits noncommercial use, and does not permit distributing the software or making changes or new works based on it.

## Acceptance

In order to get any license under these terms, you must agree to them as both strict obligations and conditions to all your licenses.

## Copyright License

The licensor grants you a copyright license for the software to do everything you might do with the software that would otherwise infringe the licensor's copyright in it for any permitted purpose, other than distributing the software or making changes or new works based on the software.

## Patent License

The licensor grants you a patent license for the software that covers patent claims the licensor can license, or becomes able to license, that you would infringe by using the software.

## Noncommercial Purposes

Any noncommercial purpose is a permitted purpose.

## Personal Uses

Personal use for research, experiment, and testing for the benefit of public knowledge, personal study, private entertainment, hobby projects, amateur pursuits, or religious observance, without any anticipated commercial application, is use for a permitted purpose.

## Noncommercial Organizations

Use by any charitable organization, educational institution, public research organization, public safety or health organization, environmental protection organization, or government institution is use for a permitted purpose regardless of the source of funding or obligations resulting from the funding.

## Fair Use

You may have "fair use" rights for the software under the law. These terms do not limit them.

## No Other Rights

These terms do not allow you to sublicense or transfer any of your licenses to anyone else, or prevent the licensor from granting licenses to anyone else.  These terms do not imply any other licenses.

## Patent Defense

If you make any written claim that the software infringes or contributes to infringement of any patent, your patent license for the software granted under these terms ends immediately. If your company makes such a claim, your patent license ends immediately for work on behalf of your company.

## Violations

The first time you are notified in writing that you have violated any of these terms, or done anything with the software not covered by your licenses, your licenses can nonetheless continue if you come into full compliance with these terms, and take practical steps to correct past violations, within 32 days of receiving notice.  Otherwise, all your licenses end immediately.

## No Liability

***As far as the law allows, the software comes as is, without any warranty or condition, and the licensor will not be liable to you for any damages arising out of these terms or the use or nature of the software, under any kind of legal claim.***

## Definitions

The **licensor** is the individual or entity offering these terms, and the **software** is the software the licensor makes available under these terms.

**You** refers to the individual or entity agreeing to these terms.

**Your company** is any legal entity, sole proprietorship, or other kind of organization that you work for, plus all organizations that have control over, are under the control of, or are under common control with that organization.  **Control** means ownership of substantially all the assets of an entity, or the power to direct its management and policies by vote, contract, or otherwise.  Control can be direct or indirect.

**Your licenses** are all the licenses granted to you for the software under these terms.

**Use** means anything you do with the software requiring one of your licenses.

2. FunGen Supplemental Terms

What an off-the-shelf licence cannot cover: the Pro Pass, the AI models, and who owns the funscripts you make.

# FunGen Supplemental Terms

These Supplemental Terms apply **in addition to** the PolyForm Strict
License 1.0.0 in the accompanying `LICENSE` file. Together they are the
FunGen licence. Where these terms are stricter, these terms apply; nothing
here grants you rights that PolyForm Strict does not.

They cover what an off-the-shelf licence cannot: the Pro Pass, the AI
models, and who owns the funscripts you make.

Definitions used below: **FunGen** or the **Software** is the FunGen
application in any form - source, binaries, installers, app bundles, and
everything shipped with or downloaded by it, including the machine-learning
model weights, encrypted or otherwise. **Pro AI Features** are the features
unlocked by a Pro Pass that generate or modify funscript data automatically:
the AI/ML trackers, AI suggestions, and batch generation.

## 1. Pro Pass

A Pro Pass (`.fgpass`) unlocks paid features. It is a personal entitlement
to use those features. It is **not** a sale of the Software or of any copy
of it, and it grants no right to distribute anything.

**A Pro Pass may stop working in these cases:**

1. The payment behind it was reversed - a refund you asked for, or a
   chargeback.
2. It was shared, published, leaked, resold, or obtained from anyone other
   than the licensor.
3. It was never issued by the licensor, or the Software was altered to
   bypass these terms.

**What is not, by itself, a breach.** Reinstalling, upgrading, changing
computer, replacing hardware, reinstalling your operating system, working
offline, activating again after a gap, or installing the pass on machines
you personally own or control. A review, bug report, complaint,
disagreement, or other opinion about FunGen is not a breach of these terms.

- A Pro Pass is issued to **one person**, and is for that person's use only.
  You may install it on the machines **you personally own or control** - for
  example your desktop and your laptop. It is not a site, team, household,
  or organisation licence.
- A Pro Pass is **non-transferable**. You may not share, publish, lend,
  resell, or otherwise pass on a Pro Pass file or its contents, and you may
  not let anyone else use the Software through your pass.
- A Pro Pass that is shared, published, leaked, not issued by the
  licensor, or used to circumvent these terms **may stop unlocking the Pro
  AI Features**, without refund.
- A time-limited Pro Pass unlocks paid features for its stated term only.
  When that term ends the Pro AI Features stop. A perpetual pass has no
  stated expiry date.

### One person, in practice

"One person, on the machines they personally own or control" means:

- **One person on one machine at a time.** Installing the pass on your own
  desktop and laptop is permitted. Simultaneous use on more than one
  machine is not.
- **No shared access.** Letting another person use FunGen's paid features
  through your pass is sharing, including on hardware you own or control.
- **Nobody can sell you a pass but the licensor.** A Pro Pass obtained from
  a reseller, a marketplace, a group buy, a forum, or any third party
  grants **no rights at all**, whatever you paid for it. It remains the
  original holder's pass, it is treated like any other shared pass, and
  the money you paid is a matter between you and whoever took it.

### If Pro stops working and you think it should not

If you believe Pro access stopped in error, request a review at
**support@fungen.app**. Where more than one person needs access, each person
needs a separate pass or a Commercial Licence (section 4), as applicable.

## 2. No circumvention

You may not:

- circumvent, disable, bypass, or interfere with any licensing, entitlement,
  metering, or protection mechanism in the Software;
- decrypt, extract, convert, retrain on, or repackage the Software's
  machine-learning model weights, or make them usable outside the Software;
- reverse-engineer the Software in order to do any of the above; or
- create, use, publish, or distribute any patch, crack, keygen, counterfeit
  Pro Pass, loader, or instructions for producing one.

Obtain FunGen only from the official channels. Do not re-upload or mirror it
(PolyForm Strict already forbids distributing the Software; this is a
reminder, not a new restriction).

## 3. The funscripts you make

**Scripts you author or edit yourself are yours.** Funscripts you create by
hand in FunGen's editor, or that you have made your own through your own
editing work, belong to you. The licensor claims no ownership of them and no
royalty on them. You may use, publish, share, and **sell** them freely.

**Selling scripts made with the Pro AI Features needs a commercial licence.**
If you use the Pro AI Features to generate a funscript, or to assist you in
authoring one, and you then sell that script or otherwise monetise it, that
is a commercial use of FunGen and requires a Commercial Licence (section 4).
Letting the AI do the work and then charging for the result is exactly what
the noncommercial licence does not cover.

**Sharing AI-generated scripts for free is fine.** Publishing scripts made
with the Pro AI Features to the community, at no charge and with no
commercial benefit to you, is a noncommercial purpose and is permitted.

**The licensor never owns your scripts.** Whatever route produced a
funscript - your own editing, the Pro AI Features, or both - the licensor
claims no ownership of it, takes no royalty on it, and needs no credit in
it. What the licence governs is the use of the Software, never the output.

### Scripts made under a Commercial Licence are yours permanently

Where a Commercial Licence (section 4) covers your use of the Pro AI
Features, the rights it grants over the funscripts generated while it was in
force are **permanent and irrevocable**. They survive the end of that
licence, however it ends, including expiry, termination, non-payment, and
withdrawal of the passes themselves.

You may keep using, publishing, distributing, selling, and otherwise
commercially exploiting those scripts afterwards, with no further payment
and no further permission. Ending a Commercial Licence stops you running the
Software and generating new scripts with it; it never reaches back into work
already produced under it.

FunGen stamps a `creator` and a `license` line into the scripts it writes,
and only where the file leaves that slot empty. Under a Commercial Licence
both lines name the licensed organisation, so a script carries which licence
it was made under. They are metadata fields like any other, editable in the
Studio, and they make no claim on the script.

## 4. Commercial Licence

Any commercial use of FunGen - including selling scripts produced with the
Pro AI Features, use by or on behalf of an organisation, and use in a paid
production pipeline - requires a separate written Commercial Licence from
the licensor.

A Commercial Licence is a written agreement between the licensor and one
named organisation. These terms are the frame every such agreement is built
on:

- **It is granted per seat.** A seat is one named person, on the machines
  that person uses for the organisation's work. The agreement names how many
  seats it covers. Each seat is an ordinary Pro Pass whose signed label
  carries the organisation's name, so the Software shows a Commercial
  Licence notice while that seat is active. Section 1's one-person rules
  apply seat by seat, and the organisation is responsible for keeping seats
  and people in step.
- **It runs perpetually or for a term**, as the agreement states. A term
  licence covers its stated period; its seats stop unlocking paid features
  when it ends. A perpetual licence does not expire.
- **It does not permit selling, reselling, sublicensing, or redistributing
  FunGen itself.** A Commercial Licence covers commercial USE through the
  seats it names.
- **Scripts already generated under it stay licensed permanently**, as
  section 3 sets out. That is a term of the licence, not a courtesy.
- **Where the written agreement and these Supplemental Terms differ, the
  written agreement governs** for the organisation it names.

## 5. Third-party components

FunGen incorporates third-party components, most of them open source and one
of them not, each under its own licence. Those licences govern those
components, and nothing in the FunGen licence limits your rights under them.
See the accompanying `THIRD-PARTY-NOTICES` file for the list and the required
attributions.

The exception is Microsoft's DirectML, redistributed in the Windows bundle
under Microsoft's own terms rather than an open-source licence. Those terms
are supplied with it, as `licenses/DirectML-LICENSE.txt`, and they are what
govern your use of that component.

## 6. No warranty, no liability

The disclaimer in the PolyForm Strict License 1.0.0 ("No Liability") applies
to these Supplemental Terms in full. The Software is provided as is, without
warranty or condition of any kind.

Nothing in the FunGen licence excludes or limits any liability that cannot
lawfully be excluded or limited, or affects the statutory rights you have as
a consumer.

## 7. Changes

The licensor may publish revised Supplemental Terms for future versions of
the Software. The version shipped with a given build governs that build. The
canonical current text is published at <https://fungen.app/license>.

**A revision never applies backwards to scripts already made.** Rights
already granted over funscripts generated before the revision - including
the permanent commercial rights in section 3 - are not reduced, withdrawn,
or made conditional by any later version of these terms.
